Professional Misconduct
Medical professionals practicing in New York are subject to investigation and potential disciplinary
action by the New York State Department of Health Office of Professional Medical Conduct. Other licensed professionals are subject to investigation and potential disciplinary action by the New York State Education Department's Office of the Professions.
Geisler & Gabriele's litigators are well-prepared to handle professional, regulatory, audit, licensing and criminal matters.
In matters of professional conduct and discipline, the attorneys at Geisler & Gabriele understand that each client's livelihood and reputation is on the line. Given the gravity of the proceedings and the possible consequences (censure, fines and even license revocation), only the best representation will do. Geisler & Gabriele takes these matters as seriously and personally as the firm's clients do and zealously strives for favorable outcomes.
Office of Professional Medical Conduct and Physician Discipline
The Office of Professional Misconduct (OPMC) is responsible for investigating complaints about physicians, physician's assistants and specialist's assistants. These complaints involve a wide range of possible acts of alleged misconduct, including but not limited to fraudulent practice, gross negligence, criminal activity and practicing while under the influence of alcohol or drugs.
The OPMC launches an extensive investigation into each complaint before any disciplinary hearing is held with the medical processional being investigated. If there is sufficient evidence that a professional may have acted inappropriately, a disciplinary hearing is held before a committee of the Board for Professional Medical Conduct.
By the time a medical professional is called to a disciplinary hearing, the OPMC has already gathered substantial evidence of alleged misconduct. Given the gravity of the proceeding and the possible consequences (license revocation, fines, censure), only the best representation will do. Geisler & Gabriele's attorneys have extensive experience defending medical professionals before the OPMC, and litigate every claim with the vigor, tenacity and savvy that our clients need when facing such potentially devastating charges.
Office of the Professions
The New York State Education Department's Office of the Professions, through the Board of Regents, investigates and prosecutes alleged misconduct in all licensed professions other than medicine. Examples of professional misconduct range from patient abandonment to criminal behavior to tortious conduct, just to name a few. If the Board of Regents finds a professional guilty of misconduct, the potential ramifications include censure and reprimand, heavy fines (up to $10,000 per violation), and even license revocation.
Disciplinary action by the Board of Regents could mean the end of a career. When so much is at stake, clients can take comfort in the knowledge that Geisler & Gabriele's team of experienced litigators provides superior representation when the firm's clients need it most.
